Want an easy way to reduce the time and cost of your conveyancing?

Three quarters (76%) of the customers who use our free online service, Application Enquiry, agree that it reduces the time they need to speak to us about their registration applications. We all know the expression ‘time is money’, so if you are a land or property professional, are you using the service and reducing your costs like your competitors?

What is Application Enquiry?

Application Enquiry has been giving land and property professionals accurate information about pending registration applications since March 2016. To use it, you’ll need to be signed up to use our Business e-services through the HM Land Registry portal.

The service offers you an online tool that supports the way you already monitor and manage registration applications. You can use it to search the applications that have been lodged with us for registration, and use a variety of references to check:

  • an application’s progress status;
  • the reason an application has been delayed, where applicable;
  • if a charge has been discharged;
  • information about recently completed or cancelled applications; or
  • the full priority period for Official Searches.

Please note that you will need certain references to search for certain things. For example, you won’t be able to find out whether an application has been completed if you don’t have the relevant reference number we give you, keeping it all secure.

Why use our Application Enquiry option

Eighty-two per cent of those who have used Application Enquiry rate it as excellent, very good or good and over half (59%) agree that they are able to find all of the information they need about their applications. That’s because we’ve been enhancing the service in response to user feedback since we launched it.

Once you have found the details you need, you can save them as a PDF to keep for your records or send them to other interested parties. Our customers, such as lenders, asked us for this feature so we built it for them.

If you don’t find what you are looking for, you can contact us directly from Application Enquiry. You can even send us a request to expedite your application under certain circumstances.

Once you start using Application Enquiry, you shouldn’t need to call or email us as often, especially about the progress, status of, or recent activity with your applications. This means your organisation can focus on other priorities, while we get on with processing your applications.

We know our customers want us to improve our speed of service as a priority. Together, we believe we can drive down the time it takes us to process applications, especially new title applications, and reduce the time and cost of registration.

How to make an Application Enquiry

Our guide explains how Business e-services customers can check their current applications to HM Land Registry through the portal.

We have also put together some tips to help you get the most from the service. They include searching by the reference we supply and saving application details for later, and checking and verifying discharge activity, the limitations of requesting more information and asking us to expedite an application.

The statistics in this post have come from the Customer Satisfaction Survey we conducted between 20 February and 3 March 2017. Three hundred customers took part.

    Hello. I have just a new lease extension completed on my flat. The flat is for sale and I have a firm buyer who has had a survey done and has a mortgage offer in place. The solicitor who dealt with the lease extension is a different one from the one who is doing the conveyancing.
    1) Who should lodge an expedite request please?
    2) What information do they need to give you to lodge the expedite request correctly?

      John - the firm which lodged the actual application which needs to be expedited. We need a request and supporting evidence of the confirmed buyer/mortgage offer expiry date

    Hi there,

    I was told by the solictors vendors that we were unable to expedite the application for 25 windsor road b36 0JN as it was at the top of the que to be processed. This was 2 weeks could you inform me how close we are to the freehold application to be completed please?

    Thanks Ian, does this mean I can not complete the re-mortgage before the prior application is complete at the land registry, as I have no influence on the prior application submitted by the freeholder.

      Ali - whether you can complete is very much up to your conveyancer and lender. If they are happy that the prior application does not adversely affect your own property/title and the remortgage then that can mean they are happy to complete but very much their decision.

    Natasha - I'm responding as Adam is currently unavailable. Once expedited, we aim to start consideration of the case within 10 days. The expedition also ensures that the case will proceed through each stage as quickly as possible. As Adam has mentioned, there are number of processes on this type of application which can delay things and these cannot be circumvented even on expedition, so it's not really possible to give a definitive timescale to completion at this stage.

    T&J - if it’s a first registration then the average timescale between receipt and consideration by us is 6 weeks. Expedition, if approved, reduces that timescale to 2 weeks. Everything then hinges on it being in order. We would not amalgamate the new and existing title unless they applied for us to do that and it was possible to do. You’ll need to rely on your conveyancer and the seller’s conveyancer to update you re progress and the detail behind the application(s) made.

      Thank you for your reply. The main delay we are experiencing is regarding the small parcel of land adjacent to the property (very roughly around 20 square metres). Can you please tell us if an application has been lodged to expedite the registration of this title?

    Thanks Adam for getting back to me so quickly. I'm a little confused. Do they need to provide evidence that I currently own the property in question, or that we are selling the property and have a buyer who will purchase it? I'm happy to chase my solicitor I just want to be able to provide any documentation as soon as possible.

      Kenl - we would need documentary evidence to confirm you have a buyer e.g. copy contract or memorandum of sale. I've spoken to the processing office though and they've resolved things it seems and the application has been completed.

    Hi, I am currently in the process of selling a parcel of land. The land consists of 1 title and we are now attaching 2 smaller parcels to it, hopefully to form a new title which will encompase the 3 seperate parcels. We have a buyer for it but they want the title document updated with the Land registry before they will move to legal exchange, that shows everything under 1 title. Apparently this is because their mortgage company won't accept any additional land being bolted on to the original title at a later date.
    Is there a way to expedite processing these 3 parcels into 1 title with the Land registry, some sort of payable service or fast track option - or are we going to be subject to the usual waiting process of 3 or so months? Many thanks

      Hi. When applying, or after lodgement, expedition of the application can be requested. If granted, we aim to consider the application within 10 working days. There is no fee for this and any request should be accompanied by appropriate evidence of the dependent transaction.

    Good Afternoon

    Could you let me know please how long it normally takes to get a restriction removed against a property please. we were told 14 days and we have been waiting over 21 now. it relates to how the property owned was owned by the seller and his late wife. we have chased up constantly with both ours and the sellers solicitor but can't seem to get a definitive answer on where our case is

      Steve - average wait time between receipt and consideration is 10 working days. Everything then hinges on what is being requested, by whom and what wider checks (if any) are required. So it is impossible to be definitive re such matters. The solicitors should be able to check on progress online using their business e-service accounts
      Do you have the title number?

    Samantha - If it's not showing on our system we won't hold any more information, I'm afraid.

    If you are asking about a timescale for completion when we do receive it, if the expedite is granted, we aim to consider the application within 10 working days. It will then depend on the individual case as a number of processes are involved and if the application is not in order, we'll need to raise a query with the solicitors acting.

    Where there is a particular urgency, it would be best to get the solicitors acting to make this clear as part of the expedite request. We can't give any guarantees, but we'll do our best to help.

    Rg - the key is that initial consideration by one of our lawyers as it is not an everyday application. Invariably such applications involve a degree of dialogue between us and the lodging solicitor to confirm specific details. Everything then hinges on next steps.
    Whilst such applications can, where no issues arise, be processed quite quickly in my experience 2-3 weeks and taking you up to Christmas, is very unlikely. But you do need to rely on your solicitor here as to timescales/options and much will depend on the outcome of that first stage.

      Rob at our end it seems we have been in touch with the conveyancer before Christmas to confirm that their application has been expedited. But as yet we have not fully considered it. The seasonal break will have impacted here but hopefully it will be considered shortly
      The conveyancer should be able to keep you informed as to progress

      Paul - a request to expedite is normally considered within a few days but you have to include documentary evidence to confirm the urgency involved. Once expedited then it’s normally considered within 2 weeks. Everything then hinges on it being in order

    Hi, I am purchasing the property - Title: WYK451150. There was an area on the plan shaded in blue (I know what it is) which wasn't noted on the title deeds. I understand (from a call to the Land Registry) that an application for an "amendment" was made around 3rd December 2019 - but no one seems able to tell me what this is or whether it has been completed. I understand we are awaiting a Completed Register of Title - does that mean that the amendment has been made and we are just waiting on the document or is there more that needs to be done? Is there any idea of timescales on this? I can't seem to get a straight answer from solicitors - it's becoming very frustrating for both me and the vendor. Many thanks for your help!

      Hazel - we have established that the register needs to be amended and emailed the seller's solicitor on 3rd December but as yet they do not appear to have responded. As the buyer I would suggest that you/your solicitor contacts the seller's solicitor and ask them to respond to our email of the 3rd December.

    Hi Adam,

    I have a pending title split that has been running for a month now of which is holding up a re-mortgage, but the re-mortgage is to pay off family loans of which I'm paying interest on as well as credit cards etc.
    Does this reasoning constitute a priority...?

      Jamie - most likely yes so the conveyancer needs to submit a request to expedite and also provide documentary evidence to confirm the issue as described. They should be aware of what is required

    Hi
    Early last year in May 2019 i went through the process of renewing my lease to sell my property. My solicitor sent me all the confirmation emails in September 2019 telling me it had completed and now i am just waiting on the registration process with land registry so i went ahead and sold my property that same month.

    Is there any way of knowing when this will complete? as my buyers solicitor says they will not exchange before registration is complete at land registry and my whole chain is about to collapse as it is taking to long. I have asked the solicitor to expedite several times but they just give me excuses. Is there any way i can expedite myself or even check if my solicitor has even requested to expedite?

    The title number is SGL539251

      Steven - the application was lodged in late October (prov title SGL807813) and no request to expedite has been submitted it seems. If the matter is now urgent, as you have a confirmed buyer, then the solicitor needs to request expedition and submit documentary evidence of the confirmed purchase. They should know the drill but check with them as to whether there is any reason why they would not be making such a request. We need the request and evidence from them in these cases as it's their application and although you are the client there may be a reason for their reluctance to make a request.
      Without expedition it is unlikely that the application will be considered until late May/early June as things currently stand

      Nick - the pending application (HD585302) has not been expedited but processing did start earlier this month. We have been in touch with the lodging conveyancer to resolve a few issues and they have recently replied. The application is now back with the nominated caseworker so will be reconsidered shortly.

        It's disappointing that the request was not expedited as it has been holding up our sale for some time now. Would there be any benefit to expediting the case at this stage?

          Nick - reconsideration normally happens within a few days of replies being received. There is no benefit in trying to expedite it now as expedition reduces the wait time between receipt and consideration. That wait time is now over

    Hi,

    The original deeds to my property seem to be incomplete at land registry. How does this happen? and how to i obtain new deeds that contain all the proper information i need to sell my property? The sale of my property has his a stumbling block as the buyer's solicitor will not proceed without complete legible documents. This was never an issue when i purchased the property 12 years ago, how come now there is an issue with the deeds and title plan ect?

        Hello ,
        We are in the process of selling our house and are just at point we were expecting to exchange. It now appears there is an anomaly on the entry for our property regarding a garage that was part of the property when my parents bought the house in 1961. The entry shows the garage as being partially outside the boundary line. Our buyers solicitor say if this cannot be amended ( not sure what that means ) we need to apply for adverse possession ( not sure what that means either. Is there any way we can pay an enhanced fee to have the entry amended? We have all the original deeds and the planning permission documentation from 1961. Any advice would be most welcome. I am completely new to this and my Mother is elderly and confused so can’t give me any history, although no issue has ever been mentioned by her or my late Father in the past .

          Catherine - any amendment has to be applied for. If there was an error made in registering it and you have deeds to prove that then an application can be made on that basis.
          If there was no error but someone has effectively extended their boundaries/built on land registered to someone else then a claim as to ownership now might be required. That’s what adverse possession refers to.
          There is no enhanced fee involved. But someone will have to apply and it reads as if the solicitor is trying option 1 first with option 2 as a possible next step if the first fails

            Thanks for that. Any idea how long it would take for an error to be corrected? I’m having the plot measured to confirm that the garage is within our boundary. Do you think that a mortgage lender ( for our buyers) would accept evidence that there has been an error in advance of Land Registry plan being amended ?

            Catherine - all depends on what that evidence was I suspect but very much a Q for the lender.
            You need to rely on your legal advice here as measuring the plot inc the garage simply confirms the plot size and measurements. If that is larger than the registered extent you’ll need to resolve that as your solicitor has explained. Just because the plot and garage exist at a larger size does not mean the registered extent is just changed to match. That is not how land law works re such matters hence you needing to rely on your legal advice. The buyer will be doing the same

    Hello

    We are in the final stage of selling our freehold MAN352115 (and lease GM111492). The buyers solicitor is questioning the rentcharge and has requested a deed of variation to remove 1925 law of property rights to satisfy the buyers lender. Our sale fell through in December 19 and the property sold again at the start of January. Apart from this enquiry, the chain should be able to complete so it is very urgent.

    I have spoken to the rentcharge owner and they are not keen on a variation believing that it will be very expensive - instead they have offered to sell the rentcharge for £250 plus £240 legal fees and can produce the paperwork in a few days - I'm not sure but it might be a deed of release (I need to check with them). I am concerned that the Land Registry may not be satisfied with the documents and not remove the rentcharge from the register if I go ahead with the transaction.

    Is it a case of having evidence that they are the rentcharge owner and if so what should I request as part of the transaction e.g. copy of the rentcharge deed (or is a copy available at the Land Registry charges register please)?

      Paul - they will need to produce evidence to show that they are the rentcharge owner. We are aware of the rentcharge created in the 1923 Conveyance so they will have to show how they have acquired it and are this able to now sell/release it. A copy of the rentcharge deed and register would not be sufficient as I assume the owner now is not the same as the named company. I'd recommend you seek legal advice as to what is sufficient to confirm their ownership and ability to sell/release the rentcharge now

    Hi Adam

    Thanks for your reply. I have solicitors for the sale of our house and will pass it over to them but before I do I would like to get my facts straight so I know what to ask for from the rentcharge owner to agree the purchase of the rentcharge and whether I should pay the £490 up front.

    Looking at some old correspondence that we received when we bought the house, in 1992 the rentcharge was being paid to The Trustees for N.O. Gartside (possibly a director of Wingfield Park Est Co). In approx 1994, the current rentcharge owner acquired the rentcharge. Would the purchase in 1994 be sufficient proof of ownership and would I need to ask for this purchase deed as part of the transaction or would a copy be sufficient for Land Registry? Or do we need documents all the way back to 1923?

    Also, if it is a sale (and not a deed of release) does it need to be sold to the current title holders (myself and my wife) to merge with the title so that we can apply for the rentcharge to be extinguished? Which way is easier - release or sale please or does it not matter?

      Paul - we would need evidence of a good root of title re the rentcharge so going back at least 15 years from the date/deed on which the current owner purchased it. The requirements would be the same re that root of title as if you were trying to prove title to an unregistered property
      If you acquire the rentcharge then you can apply to cancel it on merger by producing the root of title and new deed whereby you bought it. A deed of release releases the rentcharge to the owner. I don;t think one is easier than the other as same requirements by and large but I'm sure your solicitor can advise which is easier from a conveyancing perspective

        I've just spoken to the rentcharge owner and he acquired a number of rentcharges in December 1993 including the one on our property. The prior deeds proving root of title may refer to multiple rentcharges or he may simply not want to part with the originals. In either case, would copies certified by his solicitor be acceptable if lodged by my solicitor or would he need to forward the originals to my solicitor(I doubt that is an option)?

            My solicitor has advised for me to agree a sum for the redemption and receive a confirmation from the rentcharge owner which should be forwarded to the buyers solicitors for them to register on completion. Should I request root of title copies certified by the buyers solicitors even though they are not the solicitors ultimately filing the redemption?
            He has offered to sell the rentcharge to me as mentioned - if this is the only option he will offer, does this mean that I then produce a deed of redemption for the buyers?

      Simon - the application was received on the 9th March. 2-5 days is too short a timescale but it should be considered in the next few working days. The lodging conveyancer/firm can track it's progress online for you and confirm when completed or if any issues are raised with them

    I am about to offer to pay for a Deed of Release for the rentcharge on MAN352115 from the rentcharge owner as it appears to be the only way that we can sell our house without losing the sale.

    I just need to clarify that certified copies of root of title signed by the rentcharge owners solicitors and filed by the buyer solicitors when they redeem the charge are sufficient? I have asked my solicitor but she is not sure.

      The rentcharge owner purchased the rentcharge in 1993. I have found this definition of good root of title on the web :

      The good root document – which is the document which shows that the seller is the current legal title owner and must be at least 15 years old at the date of the contract.

      So is the conveyance in 1993 sufficient please (and can it be a certified copy from their solicitor as my last question)?

        Paul - a root of title starts with how the current owner purchased it and goes back at least 15 years form there. We won;t confirm what is acceptable ahead of an application as it is for you/your conveyancer to confirm who now owns it and to satisfy yourselves as to the root of ownership. We will only consider it once an application is submitted.

    My solicitor said she put an application in to take off a restriction to sell my late fathers home , when i called the land registry they said no new application has been made. I spoke to my solicitor again and she said they have another way to send applications through a different portal.Land registry said there is no such thing, am i right to start panicking and is my solicitor giving me false information?

      Jerry - the portal is an e-channel for solicitors to use. They can also apply by post. Both still end up with us and on a single system so if we haven’t got an application, then we haven’t got one irrespective of how it was submitted.
      I wouldn’t be panicking and would simply ask them to confirm title number, our case reference and date of lodgement. They can also check and confirm whether it’s waiting to be processed or the stage reached through their portal. So no need to contact us as they have all the information you need.

      CM cKittrick - if it’s expedited then it will be processed ASAP. Your conveyancer can check and confirm progress online inc if anything is holding it up e.g more information needed.
      I should stress that all applications to update/create a register are disrupted at the moment. All are waiting longer than usual to be processed. However expedition puts you at the head of the Q along with other expedites.

        Thankyou for your response as with it being a shared ownership it has a complicated contract to be compiled thereafter (ie more time I am told!). I do understand the hard work, the reduced workforces everywhere are making and it is appreciated.

      Teri - it was added to the systems on 15th. It’s not expedited as yet so if they asked on submission ir later then that’s not happened yet but due to the current crisis that can happen.
      I’ll flag with colleagues but I’d suggest confirming with conveyancer that they have asked and provided urgency.
      I should stress that first registrations are the most disrupted type of application at present as they are paper/office based. So whilst expedition helps it doesn’t mean it can be completed immediately or in days. So you are likely to still bear with us but we will process it ASAP

    Daniel - there are several applications against that title. None are expedited so if the conveyancer has lodged an application then get them to check case ref and confirm they’ve requested expedition and lodged documents to confirm urgency

    Hello.
    My two sisters and I inherited our parents house about 3 years ago. The next door neighbour bought the bottom of the garden in 1984 but didn't move the fence or register the boundary and our solicitors have just finished sorting this out. The title number is BK102695, his is ON89253. I think this also includes a request to be allowed to move the same neighbours services, which run down the side of the garden.
    Our solicitor tells us it will take over 9 months to register. The neighbour thinks nothing more should be done but we are unable to sell the house. It would be great if you could please see if you could help out. Thanks very much, Mike

    The neighbour's solicitor has been having a major health issue for the last year and I'm not sure he's even at work any more. We were hearing from a Locum every few weeks, if that. Would you be able to accept something from our solicitor, if I can trace her on her furlough, or is this a lost cause?

        It is all a bit confusing... we were informed that the request to land registry was made about 7-8 weeks ago... with this reference number: WSX179592.

        We were then told that this had been expedited last week on the 28th April. Yet when they e-mailed me today, I've been given WSX399857 and K194KKR.

        So, have they never put through the actual request to land registry?

          Daniel - there are a number of applications against the earlier title you posted. None of them submitted by the same conveyancer. However I have very limited access to the specific details so I’d be loathe to say Y/N re timing of actual request.
          I’ll ask a colleague to take a look to see if they’ve requested expedition as if they haven’t then there’s going to be a lengthy delay

            Daniel - the details you have are correct and the application was lodged on 5th May by Sharratts. Colleagues can’t match anything previously on the other title so best to ask conveyancer to confirm for you. I’ve had it expedited

    Hello, Please is it only solicitors that can ask for a case to be expedited? My husband and I bought a house in 2018. The title number is HD135567. He passed away recently which coincided with when our fixed mortgage offer was coming to an end. I tried to remortgage with the same bank but to my dismay found out that the original solicitor we used set it up as tenants in common. My husband and I didn't spot this, so now the bank is saying that they need proof that the title has been updated and probate before they can remove his name and allow me to remortgage. The current variable rate is causing me financial difficulty. the form to update the title seemed easy enough to do so i completed it on my own and sent it back with death certificate which you have acknowledged receipt of. I'm just struggling to pay the increased amount at the moment and will benefit from it being expedited but can't see how I can do it. If not, will it be quicker to pay a solicitor and lodge another change then ask them to expedite? Thank you so much for all your help here

      Nikki - I’m very sorry as I should have acknowledged your recent loss and I’m sorry to read that.
      The tenants in common (TIC) aspect can be confusing but you appear to have worked it out correctly. If you have sent a form DJP then that will update the register re your legal ownership and remove your deceased husband’s name.
      However it won’t deal with the form A restriction which the solicitor applied for when you were registered and which many associate with the TIC aspect you refer to. In order to cancel that you will indeed need a form RX3 and ST5.
      The alternative to the ST5 would be a certificate from a conveyancer confirming the same details but I assume at this stage you are not using a conveyancer but will do for the remortgage.

        Thank you so much for your quick response. Yes can you please put the pending application on hold. I was applying for remortgage with the same bank to move to a better deal so was told I didn't need a conveyancer as it's classed as a product transfer.

        I will complete rx3 and st5 and put it in the post this morning, please finally how can I ask for it to be expedited? I have wasted time, I didn't have trying to save money by doing it myself instead of paying a solicitor and so annoyed with myself.

        It's neither here nor there but still have no idea why solicitor would have registered it as tenants in common without a conversation and rely on us to spot it in paperwork.

        Sorry Adam, I also wanted to add that I've just dug out the letter from the bank and it says and I quote ''...If you are entitled to ......'s share of the property and wish to change the name on the mortgage, we will need confirmation that the title deeds have been updated at the Land Registry and grant of probate and written confirmation from the executors (in this case, its me) that you are entitled to .........'s share of the property.

        So not sure if just the DJP will update the title deeds. I will call the bank for confirmation. I have put the Rx3 and ST5 in the post just now so my question is whether its possible for the pending application to be expedited and then if it's not adequate for the bank, ask for the RX3 to be expedited too. I'm honestly just looking for the quickest possible way. I appreciate most will have a sob story but paying nursery fees for twins (classed as key worker so still sending them in) plus increase in mortgage payment is crippling me.

            Thanks Adam, the bank has confirmed that they just need the register updated and not the Form A restriction removed so once I hear back from land registry, I should be able to proceed, then i guess the restriction can be removed at a slower pace.

            I 'm not asking for a specific timeframe but am i likely to hear back by the end of the month at the latest?

            Nikki - the application was completed on the 18th and the register updated. That register is available online.
            The letter confirming the update plus a copy of the register will have been issued by 2nd class post. If that hasn’t arrived at your Borehamwood address then it may be still in transit or lost in the post. If you want it reissued then you’d need to use our contact form https://help.landregistry.gov.uk/app/contactus_general to enquire, advise and request it. I should stress that you don’t need it to now move things forward but I do appreciate why you would want it for completeness

        Hi, is there anything you can tell me about how this application is progressing? Our sellers solicitor is refusing to ask for it to be expedited as he says there isn’t grounds for it to be expedited. So all parties are just waiting we are only a chain of 3. we haven’t exchanged contracts yet but our buyer is likely to pull out in the coming days and force us to pull out of our purchase unless we can get a rough idea of when things can proceed.

      Melanie - if it’s been expedited then it will be considered ASAP. First registrations involve actual paper deeds and as such that plus the closure of our offices makes processing them extremely tricky and as such will inevitably lead to delays. We are managing to process the majority but it’s not a quick thing. You will have to bear with us I’m afraid

          Melanie - expedition reduces the wait time between stages so once expedited it will normally b3 considered within a few days. If it’s all in order and no wider checks are needed then it’s completed there and then.

            Ok Adam, but its in excess of 13 weeks now since we submitted the paperwork and the cheque was cashed. This is the only thing outstanding with regards to my late father's estate and until its put to bed its very hard for my sister and I to move on with the grieving process.

    Hi, our solicitor apparently sent an application to register our house (first registration) yesterday.
    Our buyers’ solicitor are insisting that it is registered prior to exchange/completion.
    Our solicitor sent a memorandum of sale as evidence and asked for the application to be expedited.
    I appreciate that it might be difficult to give a definitive answer, but is it possible to get an estimate of how long it’s likely to take to register the property please? Am experiencing financial hardship and the sale was agreed last December!

          Hi. Our conveyancer has said “ We cannot expedite the matter using the Land Registry portal until we have either the proposed new title number or a Land Registry reference.“

          They sent the request for a first registration, by post, on Monday or Tuesday.

          I’m confused as to whether the postal application will now sit with you until you can respond (as I understand this is likely to be many weeks?) or will you acknowledge receipt of the application once you have received it and then the conveyancer may use the portal to apply for expedition?

            Cassie - when registering a title for the first time we may have to carry out wider checks with adjoining or affected land/property owners. These checks often involve writing to them, in the form of a Notice, to advise them of the application and what we intend to do in creating the title.
            In this case it seems that the unregistered land/property includes a variety of rights, notably rights of way, over adjoining land/property.
            The purpose of the wider checks is to confirm the affected neighbours agree/consent to such rights being registered. They are given time to consider and then respond hence the timescale your solicitor has quoted.
            If the recipients respond and consent then the timescale can be shortened. If they do not then whilst the timescale runs out on the 24th the application will need to be reconsidered again so if it can be completed that may not happen until a couple of working days later.

            Cassie - you’ll recall I flagged it with colleagues so it was expedited then. It appears the solicitor had sent in paperwork re the urgency and that has now (yesterday) been added to the application.
            It will be considered by a caseworker as soon as possible. If in order then it should be completed. If not then it may still be subject to delay whilst that is rectified. You will have to bear with us.

            Cassie - I'm pleased to confirm that everything is order and the case is ready for completion. Most of our staff are working remotely whereas the deeds for this type of application are held in paper format at our office. So the only thing outstanding is for the application to be marked as completed on our systems and for our office based staff to return the completion documents and paper deeds to the solicitors acting. That will hopefully be done today, but I will give you a further update when I have one.

      Bethany - the application is still with us an is only partially processed. Although the solicitor requested expedition this was refused as they did not provide the required documentary evidence to confirm the urgency. They don’t appear to have responded further to that refusal.
      Whilst I can flag it with colleagues you may wish to speak to your own conveyancer not only re the current situation but also with regards your mortgage offer and any lender flexibility

            Bethany N - I can’t confirm if it’s been received. The application was submitted in such a way that anything ‘extra’ would come in separately and then have to be referred to the processing team to action. So the only information I could share would be if the application has been completed or not. As yet it has not been so I can only assume the ‘extras’ have not been matched/considered.
            Two things to flag are that firstly I’m afraid things very rarely happen at the speed someone has suggested to you. Even pre Covid it wouldn’t be done same day.
            And secondly the outstanding matters were not solely reliant on the vendor so there may still be other matters to be resolved re the wider checks I mentioned previously.

            Bethany - it’s still live so not yet completed. There’s no way for you to track progress I’m afraid. I’d encourage you to rely on the conveyancers to do that for you as they can track it through their secure portal with us.
            They are clearly checking/actioning so I’d suggest relying on them.i can see the solicitor contacted us this week and it’s back with the caseworker. But nothing to confirm or deny that it would be done today
            The blog format is not designed for dealing with such enquiries as we only have very limited access to our casework systems. We do our best to help but asking for updates numerous times and when you are getting information from elsewhere too is not the best use of this channel.
            That reads incredibly critical but it’s not meant to be. I say it simply to manage expectations at a time when the processing of applications is significantly disrupted and they may not progress as quickly as some might hope for a whole host of reasons, some of which are beyond our control.
            Happy to check again next week but I won’t approve and reply to your comment unless I’ve got something extra to add - hope that’s ok

    Hi there, I am selling my flat and purchasing another property and the chain has been ready to complete for a few weeks except for one problem, I need a certificate from the landlord but the landlord (a property company) is in liquidation. My lease is a sub-lease with the property company which bought several flats in the development and sold the leases on. The freeholder manages the building and all fees are paid directly to the freeholder anyway so maintenance etc is not a problem. My solicitor submitted an RX2 application on an expedited basis on 9 July asking for this restriction to be disapplied on this occasion so the sale can go ahead. Have you any idea how long this might take please? Feeling desperate. Title number is AGL271122. Many thanks

            Thanks Adam. However, I still haven't heard anything re the disapplication. The document sent Tuesday last week was a photo of the Notice by the liquidator disclaiming the lease so my solicitor sent it again when she received the hard copy from me the next day. As you know, we have applied to have the restrictions requiring Certificates of Compliance to be disapplied so my sale can go ahead. I cant exchange until this has been done which, of course, means my purchase can't go ahead either and the others in the chain are unsurprisingly getting impatient.     I am in the process of selling my flat and buying a house. To sell the flat we had to apply for a lease extension, which we did through our solicitor. As everything else to do with the selling and buying of the propertys is now complete our solicitor expadited the extension as we now need it done quickly for us to complete.     I urgently need this Transfer of Equity application to be registered as it is holding up the purchase of my new property. Can you please advise the status of it and how long it will take to be processed.

            Naz - as with all expedites it’s asap. When a solicitor provides more information as the application was not in order the first time it was considered, it is referred back to the caseworker to reconsider. There should be no need for you to query the progress of every application bearing in mind that process. As you know expedites are processed ASAP, which effectively means usually within 2/3 working days, your solicitor can check and confirm progress online and if all is in order when it has been completed

          M - nothing as yet but that’s no surprise as the application is a postal one. Once received it will have to be scanned and added to our systems and Covid 19 impact means that can be a drawn out process.
          Once it’s in the system the solicitor will be notified of a provisional title number and case reference. It will then wait several weeks currently before being processed.
          If it’s urgent the solicitor needs to request expedition https://www.gov.uk/guidance/coronavirus-covid-19-impact-on-hm-land-registrys-services#expedite-an-application
          So I’d suggest waiting a week at least before asking them to confirm receipt of title number/case reference and that expedition has been requested and agreed to

    Hi Adam.
    I’m wondering if you can help me please? I’m in the process of buying Garden Flat, 9 Ludlow Road, BS7 0XD and have been waiting for a new lease to be registered since April. The seller’s solicitor has applied for the application to be expedited and this has been agreed ‘subject to a requisition being satisfied.’ Can you tell me if this requisition has been dealt with and if the application has now been expedited please? If so, when can I expect this to be completed? Thanks in advance.

      J - do you know the title number and case reference? There are a few applications pending against #9 (post code is 0DX ending) but they refer to Flats A, B etc but none are expedited. If you can get some additional information that would help me identify the right one. But as none are expedited I’d get the conveyancer to check/confirm online through their secure portal

    The application was made on 6th February and is still pending. It is now holding up a remortgage which is costing me money each month and is preventing a home purchase from completing.

      J - many thanks. So all the applications are intertwined. We wrote to the solicitor raising a number of points and they seem to have replied over time. However we wrote again on 8th July as certain points remained so I’d suggest you speak to your conveyancer next to move things on and if they disagree get them to contact us through their normal secure channel.

      Dawn - expedition reduces the wait time. Once an application is expedited then it will invariably be considered within 10 working days. Currently that tends to be 2/3 days. Once considered it all depends on whether the registration requirements have been met. If they have then it’s completed at the same time. If not then more may be requested from the applicant and/or we may carry out wider checks.
      So there’s only one definitive timescale when something is expedited. It’s considered ASAP. How quickly it can be completed thereafter depends on a number of factors, not all of which are always within our control.

    Good morning, we are in the process of buying a house but in the conveyancing process it transpires that part of the garden is unregsitered and isn't included in the title deeds for the house. The sellers have been in the property for 29 years and the physical boundaries have never changed since they bought it but this obviously wasn't picked up by their solicitor 29 years ago. Our Solicitor has informed us that the sellers need to apply for Adverse Possession before we can complete and that this would take a minimum of 65 days but could be even longer. This now risks putting our whole chain in jepoardy as we have two people in the chain behind us and our seller has one in front of them. How realistic is the 65 day turn around and can this be fast tracked considering that it is holding up the sale and will potentially collapse the chain which has already taken 5 months to get to this stage. Please advise.

      Mark - if there’s an urgency then applications can be fast tracked, expedited. However that reduces the wait time. It doesn’t remove the registration requirements which have to be met and will invariably take time to complete. Those stages are generally consideration, referral to a lawyer to consider, a site visit/survey and wider checks with neighbouring/affected landowners. The last stage is I suspect the one linked to the 65 days you mention - the wider checks allow the recipients 65 days to reply. That timescale is a requirement and can only be shortened by them replying.
      So yes things can be accelerated but you are still looking at a lengthy processing time I’m afraid

          Mark - the devil is always in the detail but the only definitive timescales that refer to 15 and 65 working days are those associated with Notices we serve on affected parties. Which is served depends on the type of application.

            Mark - the application was added to our systems on 12th August. It’s very unlikely to be considered for several months unless the lodging solicitor requests expedition

            I should add that expedition will reduce the wait time for consideration to within 2 weeks but the registration requirements will still have to be met. As the application is a claim as to ownership of additional land it is possible that a site visit/survey and wider checks after that may be required.     Adam - Could you be so kind as to please give me an update RE First Registration applicaton for 37 Westfield Avenue, HD8 9AH. I believe the application was submitted via post on 06/06/20. We are waiting for the First Registration to be completed to allow us to complete the transaction. I believe the vendor/vendor's solicitor has applied for he application to be expidited. Can you confirm this and tell me wether it has been approved please. Our buyer is ready to exchange contracts and this is holding up the transaction, they would like to complete on the 21st August ideally, however this is dependant on the pending first registration on our new property.

          J - as I said before this is a complex application and it’s not one we can usefully update you in via a blog. If the conveyancer is advising you on its progress then I’d recommend you rely on that detail.
          All I can add is that they are being processed but we are in communication with the conveyancer for 9A for more information

        Has the application for this property now been expedited? I have been informed that it has, are you able to confirm this?

        Also i was wondering if my Solicitor is able to carry out all necessary searches for purchase of this property prior to the First Registration being complete? She seems to think she cannot request searches until she receives documentation when this process completes, is this correct? We don't want to delay the purchase any longer than necessary as our buyer is ready to exchange contracts.

    Hi, We are purchasing a property and adjoining parcel of land. The parcel of land (part of Title No. GR444593) has to be transferred into the executors names before we can proceed with the purchase.     Hello, I'm an MP's caseworker, and a constituent's solicitor has asked me if I can help get an application expedited, as they say they have failed to do so. They sent all details as a hard copy as requested, I think probably some time in July. The agreed sale is being held up as the property boundaries have been registered incorrectly, and this is what needs rectifying.

    We have recently completed a collective enfranchisement. This has been with Land Registry since April and we have no estimated time-frame for completion. Ref: LA6F309

    4 flats did not participate in the enfranchisement and need to extend their leases as they are now at 81 years. They cannot do so until the freehold is registered as their solicitors will be directed to the previous freeholder when they undertake their searches as he is currently still registered with land registry.

    We also need to amend the term of our own leases.

    Is this a valid reason for expediting the application? What evidence would we need to provide? Can we expedite ourselves rather than through our solicitor who is likely to charge us further fees?

    Hello, I'm in the processes of buying a leasehold flat in a converted building- the current owner bought the flat for the first time from the freeholder last year (it had been used as housing association rental prior to this) and had tried to get the lease registered then prior to selling, but the lease never got registered in time. The current owner is selling it onto me and my solicitor has requested the lease registration be expedited as I am needing to move quickly. My solicitor is now struggling to get an answer back from the selling solicitor regarding whether he has expedited this request/whether the request for expedition has been accepted.

      Mark - expedition means it is usually considered within 10 working days of that approval. It’s been considered already but as it’s an application claiming to own land it has to be considered by one of our lawyers. Hopefully that will happen in the next few days.
      In my experience, but only if the worded claim is legally sufficient, we then have to request a survey/site visit by Ordnance Survey (2 weeks timescale) and then carry out wider checks (3/4 weeks). If those two stages are needed then they can’t be expedited/rushed so you may still be looking at a few weeks still before it can be completed.
      However until the lawyer has considered it we don’t know if stages 2 or 3 are required.

      Mark - apologies for any confusion. You asked if it had been considered by a lawyer and the point I was trying to make, but failing to do so, was that referral to a lawyer could happen at any stag3 and more than once.
      The key factor here is that expedition has triggered that quick consideration and we have gone back to the conveyancer for more information. Once they supply that the caseworker and most likely a lawyer will consider it again. But that all depends on what’s supplied.

            Hi there, I’m hoping you can help and advise. The registration of the unregistered land was completed as per your last comment but the sellers solicitors made a mistake and left a very small parcel off which our lender is insisting is included in the title before completion. Although they’ve requested expedition with the new application, added to systems on 5th Nov, that isn’t picked up on due to Covid restrictions. We ask solicitors to lodge and then request expedition through a dedicated channel.
            I will ask colleagues to see if it can be expedited but you will have to bear with us.

            Thanks Adam, please whatever can be done we would be most grateful. This is the second time the sellers solicitors have made mistakes, firstly they didn’t expedite the first application because they sent to the wrong email address and then when the land was registered they had drawn the plan wrong, the surveyor has already been out and seen this missing strip of land so we are hoping it can just get resolved really quickly as it was a error on the part of the solicitor which is potentially going to collapse the chain which has been ongoing for six months.             Jas - there’s no delay as it’s a digital process that notifies them.           John J - the caseworker is going to move your new lease on and hopefully complete it very soon. The landlord’s title is a complex one and there are applications affecting it that are ahead of yours. However we should at least be able to get your part done but the landlord’s title wont be updated until those earlier matters are resolved. That may or may not be relevant to you/others involved at this stage

            John J - there’s no complication other than multiple prior applications to be completed before the details of your lease can be added to the landlord’s title. Your solicitor can explain that and the effect of priority on your own position

      Andrew - the still current expedition process means that if the request is approved the application should be considered within 10 working days. Everything then hinges on it being in order.
      A mortgage offer due to expire in the near future can be provided as evidence of the urgency and need for expedition

      Tess - it’s still with us and after an initial contact with and response from the lodging solicitor it is now with one of our lawyers. The application is to remove certain entries from the register and the evidence provided has to be considered by one of our lawyers as it is not routine.

    My seller's solicitors have applied to remove a "unilateral notice" clause in the title register of 70 Vickers Way, CB23 6EP. The unilateral notice clause was by the council and before making this application, the council had confirmed that this need to be removed.

        Our seller's solicitors received a reply early this month that they can remove the notice if the council doesn't object by the November 23rd. Not, they tried to get the updated title from the Title Registry and were told that the application is in queue and will be handled without providing any timelines.

        Is it possible to give a timeline of when we can get the title updated. I waited for 3weeks for the council to reply, then 5 weeks and 2 days for Land registry to reply, and 2weeks again for the council to not object (even though they've replied already before making the application to HM Land registry). Your reply would help me weigh whether this property is worth pursuing.

      Sheets - in my experience notices are invariably served. They are usually 15 day notices so once served you are looking at a 3-4 week turnaround still depending on responses.

      James1991 - expedition means that it should be considered ASAP. That means within 2 weeks but for most it means within 5 days. It only reduces the wait time so when it’s considered everything then hinges on it being in order.
      Your conveyancer should be able to track progress for you

    Hi, title number CH466946. My solicitor requested this document on 29th October, he was advised 10 working days to receive it. He continued to chase as did I, he requested for it to be expedited on 11/11/20 however on chasing again today he was advised that it would now be 10 working days from the 11/11/20! So requesting it to be expedited has now set the whole process back again. The whole chain is going to collapse this Friday if that document is not back. Very distressing for all involved.

      Andrena - I’m sorry things are so stressful. Repeat chasing and progress enquiries can impact on speed of progress. However each time to contact you’ll get the standard response for each request so if it’s to approve expedition then it refers to 10 working days but invariably it’s sooner.
      I’ll see if I can confirm anything more specific with the caseworker team

          Expedition reduces the wait time between expedition and consideration to under 2 weeks usually. Everything then hinges on it being in order of course.
          There’s no need to respond if they give you the specific details and confirm expedited. You’ll just need to wait a little bit longer and hopefully everything will be ok

            Steven - an application to register it for the first time was added to our systems today (Provisional title MS685434). A request to expedite has also been submitted and approved. That means it should be considered within the next 5-10 working days.
            I’d suggest waiting until towards the end of next week before asking the solicitor to check/confirm progress for you. They can do that through their secure portal hopefully

    Could you please check the status of the cancellation of restriction on my deed SK224831. My conveyancer confirmed that they have requested expedition. My buyer is pushing to get the exchange done because of the pressure from the chain. I am very concerned that they will pull out at any point. With Covid-19 in the way, I am unlikely to get another opportunity like this any time soon. Hope you can help.

    Please can you take a look at title number MS194577? An application was made on 16th Nov to remove a restriction on the title deeds, this was expedited yesterday under ref N780WPR.             Amy - Penhale View is a small development and we’ve got a series of applications waiting to be processed. One has been expedited but that’s a Transfer to a social landlord and has yet to be checked.
            So I can’t tell you if there are any issues I’m afraid but the solicitor would be the first to know if there are.

    We’re waiting for a lease extension to be recognized by the land registry to complete a sale agreed more than 4 months ago. Both ourselves ( the buyers ) and the sellers were initially planning completion > 6 weeks ago and this is the last thing stopping us from exchange (completion will be at least 2 months later than hoped). We hear from our lawyer who talked to the sellers lawyer that an application to expedite was made when the application was lodged Dec 30th. Please can you give us an idea of how long this may take ?       Emma - have they actually checked and confirmed it’s been expedited? If not I suggest they do and if it has at what stage it’s at.
      If they submitted the request at the same time as the application then I very much doubt it would have been seen yet. Some months ago now when Covid impacted we asked conveyancers to submit first and then request expedition through a specific supported channel. They also need to provide documentary evidence to confirm the sale/purchase so please make sure they do that as well

    Hope you are well. Around three months back we requested an expedited split of title SK400189, Laurels Farm Cottage NR34 8HD, justified because of the imminent expiry of short-term bridge finance (we supplied documentary evidence and covering letter).

    We have not heard anything at all, and the bridging finance expired two days ago leaving us now in a very difficult position. Can you let me know whether the expedite request was granted and if so, where we are in the queue please?

      Toby - whilst there 2 pending applications against st that title neither have been expedited. The first one which refers to a Transfer in your favour was submitted on 5th Nov but I can’t find a record of the request you refer to either against your email address or the titles involved.

            Hi Adam, I know I'm in very serious risk of being a complete and utter pain here, but I am starting to wonder if there is some IT issue going on.

            Our solicitor says she has been checking your portal twice daily for updates since the 25th and as of even 30 mins ago it was still telling her the requisition is still being dealt with your end and it is not complete, whereas you are saying above it was completed on the 25th.

            Toby - no need to apologise as I can see from our end not all the planets have aligned as yet although I’m not too sure why the second transfer and it’s new title affects your own purchase.
            The reason I said it was completed is because your transfer has been and so too has the seller’s title. For some reason the buyers title is still waiting so I am double-checking

    Hello.
    My solicitors are due to receive a deed of variation relating to our property. This needs to be registered with yourselves and will be done next week. Can I ask what I can do or is there any process to speed up applications. I ask as our solicitors have lost a lot of time chasing the wrong company for this deed which has been going on for several months and the chain we are a part of for selling this house and the house we are buying are constantly threatening to pull out if this is not resolved quickly which is why I want to do whatever I can to speed things up even if there is a cost we can pay to do this

    Hi, I’m not sure if I have the right place but looking for any kind of advice as we are desperate. We are in the process of selling our home (so close to exchange) and an enquiry has came up regarding our garage not being added to the title plan when we purchased the house 10 years ago. We’ve been in touch with our old solicitors as we have been told they must not of registered it for them to arrange to get this updated but I was just wondering how long that would take once it comes to you.       Verity - timescales are extremely stretched at the moment but that’s not really key in these cases. What is key is that once submitted the conveyancer needs to then request expedition as you have a linked/dependent transaction. If they do that then the wait time between receipt and consideration happens ASAP.

She has also attached our mortgage offer for proof as it expires soon. She’s sent me a reference of 210208-002072 if that helps.             Verity - it has been received so will be considered ASAP. I’ll flag with colleagues as well.
            One note of caution to explain here as the registered extent has been this way since 2011 so we may have to contact the developer, who is still shown as owning the extra land, before making a change.
            I’m not saying we will but I want to manage expectations here rather than say it will be sorted in a few days.

    Hi. We're in the final stages of buying a property. An issue was flagged a number of months ago my our solicitor that the end of the garden is unregistered land. He informed the vendor's solicitors, but we have just found out that their application for possessory title was only submitted at the end Jan! This is putting a big strain on the chain we are in. This application has now been flagged for expediting, but is there any more that can be done - i.e. is it possible to pay to prioritise?

      Tim - nothing more to be done as expedition will get it done ASAP. The registration requirements now have to be met re stat decs, site visit and wider checks with neighbouring affected landowners. You are looking at several weeks minimum even if each stage is done ASAP

            Hi Adam. Going back to my original question, it looks like we may be in a situation when we need to complete the purchase ahead of the possessory title being granted. From discussion with our solicitor, the case that the current owners have is strong. If the current owner are awarded possessory title after we have completed the purchase, is the title granted to them, or to the property? i.e. would it automatically be transferred to us? Thanks.

      Amy - it was lodged on 17th Dec and processing has already begun so it can5 be expedited. Unfortunately it wasn’t in order so we asked for more. Whilst we’ve had some detail provided it’s not been sufficient and we’ve contacted the company again today.     Hi, we are buying a property where it's transpired a slice of land cutting across the access to the property is unregjstered. The current owners have lived there for 27 years and their title deeds show this land included in the boundary (3 acres in total) at the time they bought the property. They have now applied for adverse possession for this area. Is it possible for absolute title to be granted or is the best outcome only possessory title?
    Also, how long will this process take as we wanf to know the outcome before proceeding further. Clearly the implications for all are significant if this causes the transaction/chain to collapse. Many thanks.

      Jane - most likely possessory title given but each case is decided on merit. Minimum 2 months as a site visit and wider checks involved but they’d need to submit if first and then request expedition to get close to that timescale.
      If that’s too long then speak to your conveyancer re alternatives in completing and mitigating against any risks

    I'm struggling to understand though how, if their title deeds when they purchased the house 27 years ago showed the entire plot as Absolute Title, how this has changed from a LR perspective in the intervening years? How can suddenly a slice of land be showing as unregistered?

    Our solicitor has put the fear of god into us about purchasing with Possessory Title on this piece of land e.g. having to wait 12 years for AT being possible and if unsuccessful the indemnity insurance being invalidated, possible devaluing of property, difficulty selling the house if we need/want to at some point and so on!

    Any thoughts/advice welcomed, thank you.

      Jane - things don’t suddenly become unregistered and everything really hinges on the paper deeds submitted at the time of first registration. You need to very much rely on your legal advice here and if you have a mortgage then your lender also has a say of course.
      If the sellers been there 27 years and they get title to it then the risk is significantly smaller than if they didn’t. But there’s still a risk for your solicitor to explain to you but hopefully they can offer some guidance/reassurance around their own experiences of such outcomes being challenged or an issue on a later sale
